Meru Senator Mithika Linturi's Case Postponed After Petitioner Fails to Show Up

On September 3, 2019, a court case between Meru Senator Mithika Linturi and Maryanne Kitany was postponed after the petitioner failed to appear in court.

Kitany's lawyer, Dunstan Omari, claimed that she was unable to attend due to the death of Linturi's father on the previous night.

Omari stated, 'She is mourning and in the process of going to Meru for the burial program… therefore she is not competent to proceed with the matter.'

However, Linturi's lawyer, Muthomi Thiankolu, objected to the adjournment, accusing Kitany's lawyer of trying to influence the case.

Thiankolu argued that there was no basis for adjourning the proceedings and that only a pathologist could determine the cause of death.

He said, 'If indeed my client caused the death let her carry her own cross…no fact has been tabled here to show that Snr Linturi was murdered. We should not take advantage of the situation.'

Magistrate Peter Gesora ultimately decided to adjourn the case for the day, citing the petitioner's absence as the reason.

The hearing is set to continue on Wednesday.
