On August 18, 2019, Justus Matage was on his way home in Madirini village, Kakamega South district, when he was accosted by Moses Munga'u, a man he knew. Munga'u, armed with a kitchen knife, stabbed Matage on the forehead, causing massive blood loss.

According to the charge sheet, Munga'u then demanded that Matage hand over all his valuables. Munga'u took the money and fled the scene. Matage reported the incident at Eregi Police Patrol Base, and a search was mounted. Two days later, Munga'u was arrested in a nearby village.

On August 20, 2019, Munga'u appeared before the Kakamega Chief Magistrate's court, where he had initially pleaded guilty to the capital offence. However, after being warned that the offence attracts a mandatory death sentence, Munga'u changed his plea. He was granted Sh300,000 bond with a surety of similar amount pending the hearing of the case on November 12.
