Kenya's private security sector faces potential shutdowns for noncompliance with new licensing rules, threatening 500,000 jobs, according to a government directive. The Interior Cabinet Secretary, Fred Matiang’i, issued a gazette notice requiring all 2,500 registered security firms to register with the Private Security Regulatory Authority by January 5, 2020, or risk closure.

Regulatory Requirements

The Private Security (General) Regulations 2019 mandate that security companies must comply with strict licensing protocols. Non-compliant firms will be prohibited from operating, with institutions hiring unregistered guards also facing legal consequences. The rules include provisions for a minimum wage for security personnel, uniform standardization to differentiate from state officers, mandatory training programs, and fees payable to the regulatory authority.

Industry Pushback

The Protective Security Industry Association (PSIA), representing the sector, criticized the deadline as unrealistic. PSIA Chairperson Cosmas Mutava stated firms required at least three years to meet requirements, arguing the current timeline would force layoffs. "We were given six months to comply and now have about three months remaining," he said. "We must be honest and say that we cannot comply with the regulations within the set deadline," Mutava added.

Implementation Challenges

The regulations, finalized in 2019, have sparked debates over enforcement feasibility. While the government emphasizes compliance to ensure accountability, industry leaders warn of economic repercussions. The directive underscores broader regulatory efforts to formalize the sector, which employs a significant portion of the workforce.
