On July 22, 2019, President Uhuru Kenyatta was briefed on a resolution to arrest Treasury Cabinet Secretary Henry Rotich, a move that marked a significant escalation in the investigation into the multi-billion dam scandal.
According to sources, immediately after the arrest order was signed by Director of Public Prosecution Noordin Haji, Rotich was asked to surrender himself at the Directorate of Criminal Investigations (DCI) headquarters.
Director of Public Prosecution Noordin Haji has ordered the arrest of Treasury Secretary Henry Rotich, Treasury Principal Secretary Kamau Thugge, and 26 other officials linked to the scandal.
The officials, including Dr. Susan Koech, PS East Africa Community, and David Kipchumba Kimosop, MD Kerio Valley Development Authority, are accused of breaking the law on public finance management and flouting procurement rules in the Arror and Kimwarer dams tender.
The tender was inflated by Sh17 billion from the initial Sh46 billion, with Haji stating that the officials' actions were a clear breach of the law.
