On July 18, 2019, Principal Magistrate Hellen Onkwani issued a warrant of arrest against Mike Muya, a police officer attached to the DCI headquarters, for failing to release the passport of a complainant in a Sh150 million fraud case.
The warrant was issued after Muya failed to appear in court to explain why he was holding the passport of Ryskulov Damir, a Kazakhstani national who was allegedly defrauded by two Kenyans.
According to Damir, he was promised coffee and artefacts by the suspects, but they ended up defrauding him of Sh150 million.
Damir told the court that he was willing to abide by any conditions imposed for the release of his documents.
The court also ordered Muya to deposit the passport in court by July 19, 2019, for Damir to collect it.
Through his lawyer, June Ashioya, Damir described the confiscation of his passport as unlawful, inhuman, and degrading treatment.
“Together with my brother Yerlan Baimoldin, we entered into a business agreement with some Kenyans who said they would sell to us Kenyan Tea, coffee, and artefacts,” said Damir in his application.
