On May 27, 2022, three voters filed a petition at the High Court in Milimani to bar Rarieda MP Otiende Amollo from defending his parliamentary seat over alleged misappropriation and loss of the National Government Constituency Development Fund (NG-CDF).
The petitioners, Mr Peter Agoro, George Bush, and Erick Otieno Onyango, claim that the MP has been holding office despite an adverse report by the Auditor-General dated February 11, 2022, which highlighted inaccuracies in the financial statements, including stale cheques, unsupported cash withdrawals, and irregular expenditure.
According to the Auditor-General's report, the financial year ended June 30, 2020, saw cash withdrawals amounting to Sh23 million made from the account without confirmation of the nature of transactions. The report also noted that there were unpresented cheques amounting to Sh2.4 million, including stale cheques dating as far back as March 2019.
The petitioners also allege that there has been loss of money and irregular expenditure of the constituency funds, as well as irregular and unclear award of a tender for the Construction of an administration block in the Constituency.
The petitioners have sued the MP, the Independent Electoral and Boundaries Commission (IEBC), the Ethics and Anti-Corruption Commission (EACC), and the Attorney General, seeking to compel the EACC to investigate the alleged loss of money and prosecute those found culpable.
The case will be mentioned on May 31, 2022, for directions at the High Court in Milimani.
