Koigi's Mother Revives Sh50m Torture Compensation Case at Supreme Court

On July 16, 2019, Mrs. Monica Wangui Wamwere, the mother of former assistant minister Koigi wa Wamwere, filed a case at the Supreme Court seeking Sh50 million compensation for Nyayo-era torture.

Her case had been dismissed by the High Court in 2016, with Justice Isaac Lenaola, now a Supreme Court judge, questioning why it took her over 20 years to file the case.

Appeal court judges Mohamed Warsame, Patrick Kiage, and Agnes Murgor upheld the High Court decision, terming the petition 'no more than a speculative afterthought.'

Mrs. Wamwere had argued that the delay was due to her lack of faith in the Judiciary under the old Constitution and the Moi regime.

However, the judges noted that since 2003, many aggrieved persons had approached the courts seeking redress, citing the case filed by Koigi Wamwere in 2000.

Through her lawyer, Gitau Mwara, Mrs. Wamwere has raised 30 grounds, including that most judges have ruled that there is no limitation of time in the Bill of Rights, especially where persons have sought redress for historical injustices.
