On July 12, 2019, the Employment and Labour Relations Court made a landmark ruling in favour of Mr. Kepha Moreno Bosire, a former Kenya Airways employee who was unlawfully sacked for wearing an Arsenal jersey.
Mr. Bosire, who was the airline's Corporate and Communications Manager, was fired by then-CEO Titus Naikuni in 2013 for wearing a jersey branded 'Fly Emirates' (Arsenal's sponsor) during a staff party.
The court found that Naikuni had used his position to intimidate and coerce Bosire into removing the jersey in front of his colleagues and guests, and that the termination was unfair.
The court ordered Kenya Airways and Naikuni to pay Bosire a total of Sh10 million, comprising three months' salary in lieu of notice (Sh1.8 million), 12 months' salary as compensation (Sh7.2 million), and a sum of Sh1 million against Naikuni personally for the undignified treatment of Bosire.
