On December 24, 2021, a High Court in Kenya issued an order for a man accused of sexually assaulting his 11-year-old daughter to face a fresh trial.
The order was made by Justice Kanyi Kimondo, nine months after the case against the suspect, identified as JNM, was withdrawn.
Justice Kimondo's decision followed an application by the Murang'a County Children Services Department, which challenged a decision by Senior Principal Magistrate Edwin Nyaga to free the suspect.
According to the order, the matter can be heard by any magistrate except Nyaga, and the suspect will be required to take a fresh plea.
