Kenyan Resident Challenges Tourism Ministry's Covid-19 Vaccination Requirement

Published on December 21, 2021, a Nairobi resident, Enock Aura, has written to the Ministry of Tourism, protesting the precondition of Covid-19 vaccination for Kenyans seeking to access game parks and national reserves.

Aura obtained a court order stopping the government from demanding Covid-19 certificates as a condition for in-person services.

His lawyer, Harrison Kinyanjui, stated that the ministry's directive to tour operators to demand proof of vaccination from clients before services is a breach of the Constitution of Kenya and the Universal Declaration of Human Rights.

“To then purport to direct independent and private businesses to prohibit and bar Kenyans from accessing public services on the basis of non-vaccination with Covid-19 vaccinations is a breach of your Oath of Office to uphold and defend the Constitution of Kenya,” Kinyanjui said.

Aura's lawyer also questioned the existence of a directive from the Ministry of Health, allegedly made on November 22, 2021, which the ministry claimed to be adhering to.
