On November 5, 2021, a Kwale Court made a significant decision in the case of Nyali MP Mohammed Ali, who had stood as a surety for terror suspect Noordin Abdalla Hassan.
The court had issued a warrant of arrest against Ali after Hassan failed to appear in court more than a dozen times, but the MP's lawyer, Titus Kirui, argued that Ali had played a key role in ensuring Hassan's arrest.
According to Kirui, Ali was instrumental in tracing and having Hassan arrested, and he wished to withdraw his surety.
Senior Principal Magistrate Joe Omido ruled that the warrant of arrest against Ali be lifted, as Hassan had now been apprehended and brought before the court.
Omido also ordered that the Sh50,000 cash bail not be forfeited, and that it be refunded to Ali upon his discharge.
Hassan, who was charged with 12 counts of terror-related charges, was remanded at Shimo La Tewa Maximum Security Prison until November 18, when he returns to court.
