On October 29, 2021, the High Court issued a conservatory order halting the Public Service Commission's consideration of two petitions seeking the removal of Director of Public Prosecutions Noordin Haji from office.
The order, issued by Justice James Makau, was in response to a petition filed by Haji, who claimed that the complaints before the Public Service Commission were null and void as they interfered with his prosecutorial powers and judicial independence.
The petitions, lodged by Gabriel Straten, sister of murdered tycoon Tob Cohen, and Ibrahim Ndung'u Ndirangu, alleged that Haji had mishandled Cohen's case and failed to prosecute Court of Appeal judge Sankale Ole Kantai, who had been mentioned adversely in the murder.
Justice Makau also restrained Cohen's sister, Ndung'u, their lawyers, or any other party from commenting or discussing the matters pending before the Public Service Commission or in the High Court, pending the hearing and determination of Haji's petition.
The case has been directed to be mentioned on November 11, 2021, for further directions.
