Man Gets Death Penalty After Losing Appeal Against 30-Year Jail Term

Published on October 27, 2021, a Kiambu court has sentenced a man to death after he lost his appeal against a 30-year jail term for robbery with violence.

David Waweru was initially sentenced to 30 years behind bars by Gatundu Law Courts in 2020 for robbing Daniel Kariuki of his Samsung mobile phone valued at Sh3,500 and Sh1,500 cash.

However, Waweru appealed against the conviction and sentence on grounds that it was excessive, which Kiambu High Court Judge Mary Kasango dismissed.

Justice Kasango noted that the Trial Court had erred in sentencing Waweru to 30 years when the law dictated that the mandatory sentence was death.

“Trial Court was misguided as many factors were overlooked and sentenced Waweru to 30 years. That sentence was illegal,” she noted.

Waweru was accused of robbing Kariuki on July 29, 2015, at Wanjeng area of Githunguri sub-county within Kiambu. He pleaded not guilty and the case was heard during which the prosecution called six witnesses to buttress their case.
