Court Upholds Ann Kananu's Swearing-in as Nairobi Governor

The Court of Appeal has dealt a blow to former Nairobi Governor Mike Sonko, dismissing his application to prevent Ann Kananu's swearing-in as the city's new governor.

On October 22, 2021, the court ruled that Sonko's arguments were invalid and had no merit, paving the way for Kananu's swearing-in.

According to the 15-page ruling, the judges found that the issue of Kananu's swearing-in was not raised in the High Court and was not a ground of appeal in Sonko's draft memorandum of appeal.

"We find that the issue of the swearing in of the 11th respondent was not raised in the High Court and the impugned judgment did not address or determine that issue. We note that issue of the swearing in of the 11th respondent was not a ground of appeal in the applicant's draft memorandum of appeal," read the judgment.

As a result, Kananu will now be sworn in as the third governor of Nairobi, a position she will hold after Sonko's impeachment and subsequent removal from office.

The respondents in the case had asked Sonko to keep away from county affairs, citing the public interest and the need to prevent him from interfering with the running of Nairobi County.
