October 13, 2021, marked a significant development in the Tob Cohen murder case as his family filed a petition at the Public Service Commission seeking the removal of Director of Public Prosecutions Noordin Haji.
The family, led by Cohen's sister Gabriel Hannan Van Straten, claims that Haji is mishandling the case and interfering with investigations, further accusing him of protecting influential individuals from prosecution.
According to the petition, Haji lacks the requisite experience to hold the office, as provided for under Article 157 (3) of the Constitution of Kenya, 2010.
The family also accuses Haji of abusing his power and office by restraining the Directorate of Criminal Investigations from arresting Court of Appeal Judge Kantai Ole Sankale, who is alleged to be involved in the murder and cover-up.
Responding to the allegations, Haji declined to charge Judge Sankale, stating that the evidence gathered by detectives was based on mere suspicions and assumptions, and did not place the judge in the murder plot.
However, the family insists that the DCI had proven Judge Sankale's involvement in the murder and his relationship with Cohen's widow.
