Published on September 28, 2021, a Court of Appeal Judge Sankale Ole Kantai has moved to court seeking a temporary injunction to block his rearrest over the murder of Dutch tycoon Tob Cohen.
The judge, represented by lawyer Peter Wanyama, claims that the Director of Criminal Investigations (DCI) wants to arrest him on matters that the Director of Public Prosecution (DPP) has already considered closed.
According to the judge, the DCI has enough evidence to charge him with forgery and fraudulently transferring shares, despite the DPP reviewing the case and finding no evidence against him.
The judge argues that the DCI's actions are 'rogue' and set a dangerous precedent in the administration of justice in the country.
He further states that the DCI's statement that he can arrest and charge suspects in court without the involvement of the prosecution is 'singularly incorrect and disappointing.'
The case involves Tob Cohen's widow, Sarah Wairimu, who is the primary suspect and is currently facing murder charges alongside her co-accused Peter Karanja.
The Dutch national was found dead in an underground tank at his palatial home almost two months after he went missing.
