Published on September 24, 2021, two Indian nationals, Anand Kumar Bharatkumat Modi and Keval Umit Shar, have been charged with conspiracy to defraud Festive Bread Company.
The two businessmen appeared before magistrate Bernard Ochoi of Milimani law courts and denied three counts of fraud, including making a document without authority and uttering a document against the law.
According to the charges, on diverse dates of April 15, 2021, and July 14, 2021, the duo conspired with intent to defraud and uploaded a forged application for cancellation of permit document for Mr. AnandKumar Bharatkumat Modi to the immigration online work permit portal.
They allegedly purported the document to be genuine and duly signed and issued by the director of DPL Festive ltd, knowing it was untrue.
Through their lawyer, Mr. Mwangi, the accused pleaded with the court to be released on Sh 30,000 cash bail, stating that Anand Kumar Bharatkumat Modi worked with complainant Festive Limited Company for one year and that his wife also worked for the company for a similar period.
Mr. Mwangi argued that the two accused left the company and are now working on their own company, which is a competitor to Festive Bread Company.
The prosecution did not oppose their release on bail but requested a cash bail of Sh 30,000, which they deemed too minimal for the offense.
The court was informed that the documents held by the accused are still subject to scrutiny, and the prosecution wants the accused to deposit a passport in court to secure their attendance.
The defense argued that depositing identification documents in court would put their work under tremendous pressure and that they would need to travel due to the nature of their business.
