Kenya: Embu Brothers' Murder Case Takes a New Twist

Published on September 10, 2021, court documents have revealed a shocking twist in the murder case of two brothers in Embu, Kenya.

According to the documents, three police officers sat in the back of a Toyota Land Cruiser with nine other detainees, including the two brothers, Emmanuel Mutura and Benson Njiru, on the night of August 1.

The officers, Benson Mputhia, Consolata Njeri, Martin Wanyama, Nicholas Sang, Lillian Cherono, and James Mwaniki, claim that one eyewitness saw the brothers jump out of the vehicle on the way to the Manyatta Police Station.

However, the court documents contradict the officers' claims, showing that the sitting arrangement in the vehicle was such that Mr. Mwaniki was driving, Mr. Mputhia and Ms. Njeri were in the front seat, and Mr. Wanyama, Mr. Sang, and Ms. Cherono were in the back with the detainees.

The officers' defence lawyer, Danstan Omari, has argued that the Independent Policing Oversight Authority (IPOA) investigation is complete and cannot be interfered with.

Mr. Omari also claimed that the Director of Public Prosecutions, Noordin Haji, ignored sections of the law that provide for an inquest when someone dies in police custody.

Justice Daniel Ogembo will hear the bail applications of the six officers on September 22.
