On September 6, 2021, a petition was lodged with the high court seeking to postpone the August 2022 general elections to August 2023.
Former nominated senator Paul Njoroge Ben is behind the petition, which argues that the Independent Electoral and Boundaries Commission (IEBC) was not properly constituted when it settled on August 9, 2022 as the date for the general election.
Njoroge claims that the IEBC did not have a substantive chief executive officer (CEO) at the time, making its decision to hold the elections on August 9, 2022 'imposed on the people of Kenya and therefore, illegal, irregular and illegitimate.'
He further argues that the IEBC's improper constitution at the time of tendering and procurement of various hardware and software materials and personnel for the elections would be 'extremely detrimental to the tax-payers and people of Kenya.'
According to Njoroge, the government has allocated billions of shillings ahead of the elections and more are yet to be released to meet IEBC's budgetary needs.
