Published on September 3, 2021, the Court of Appeal's ruling against the Building Bridges Initiative (BBI) has been upheld by Justice Daniel Musinga.
Justice Musinga's clarification comes after the Linda Katiba lobby group wrote a letter seeking rectification of the final BBI Appeal ruling, citing errors in the court's decision.
The group, represented by lawyer Morara Omoke, argued that some sections of the final ruling did not match what the judges read while delivering the ruling.
Specifically, the group pointed out an error in the total tally of judges who voted for and against the issue of whether the proposed BBI referendum should be one main question or separate individual proposals.
However, in its response, the Court headed by Justice Daniel Musinga noted that there were no errors in the final ruling, thus no need for any corrections.
"I have been directed by Justice Musinga to inform you that there is no error in the final orders, and respectfully, no correction is necessary," a letter sent to the lobby group by Lorraine Ogombe, the Deputy Registrar of the Court of Appeal read in part.
Justice Musinga's clarification dims President Uhuru Kenyatta and ODM leader Raila Odinga's hopes to redeem the BBI at the Supreme Court.
