On August 26, 2021, a landmark court ruling ordered the reinstatement of a police officer who was unlawfully sacked almost three years ago.
Justice Maureen Onyango directed the National Police Service and the Inspector General of police to reinstate Maxwell Onduso, who was sacked in November 2017, to his rank or position without losing any benefits.
The court found that the officer was not given a chance to defend himself against allegations made against him, contravening section 4 of the Fair Administrative Action Act.
Maxwell Onduso, through his lawyer Stephen Mogaka, had moved to court seeking a declaration that his employer had acted unlawfully in suspending and later dismissing him.
