Published on August 24, 2021, a Kenyan court has issued a restraining order against Ocean Airlines, preventing the company from selling or transferring its assets, including an aircraft, pending the determination of a pay dispute with its partner-turned-rival, Jetways Airlines.
Justice David Majanja issued the order, blocking Ocean Airlines, its employees, or their agents from selling, disposing, exchanging, mortgaging, transferring, or dealing with any properties, equity, or assets it owns, pending the determination of arbitration proceedings.
According to the court ruling, the freezing order aims to preserve Ocean Airlines' assets, including the aircraft MSN 21200 Fokker 27 MK 50 (Fokker 50) with registration 5Y-FAD (previously 5Y-FJE), which is currently secured at a hangar at the Wilson International Airport under the control and security of Jetways Airlines.
Jetways Airlines had moved to court seeking to stop Ocean Airlines from selling, dealing, disposing, or transferring its properties or assets and to direct the airline to provide security for the sum of USD 569,995.57 claimed by the applicant, pending the hearing and determination of the arbitral proceedings between the parties.
