Nairobi's New Public Nuisance Bill: Hefty Fines and Jail Sentences

Published on August 24, 2021, the Nairobi County Public Nuisance Bill 2020 has been formulated by acting Nairobi Governor Ann Kananu and passed by the county assembly in September 2020.

The Bill, sponsored by Riruta MCA James Kiriba, aims to curb public nuisances such as sleeping in the kitchen or other store areas where food is kept, which will now cost Sh. 50,000 or a jail sentence of up to six months.

Other offenses that will attract hefty fines include blowing one's nose in public without a tissue or handkerchief, which will result in a fine of Sh. 10,000 or a jail sentence of six months.

The new rules also prohibit living on earnings from prostitution, urinating in undesignated areas, riding motorcycles or driving on footpaths, playing loud music, and smoking in undesignated places.

According to the report, other acts that will be fined include leaving a dog to litter a public road or street, washing, repairing, or dismantling a vehicle except in an emergency in the central business district, and touting for passengers.

Additionally, hawking, selling, distributing, or advertising any article or event on any public road or street, shouting, or using any bell, gong, loudspeaker, or other noisy instrument will attract punishment.
