Uhuru Suspends Judge Mary Gitumbi Over Mental Incapacity

On August 23, 2021, President Uhuru Kenyatta issued a gazette notice suspending Judge Mary Muthoni Gitumbi from office, citing her mental incapacity and inability to perform judicial duties.

The decision was made after the Judicial Service Commission and various medical reports concluded that Judge Gitumbi was not in good mental health to remain in office.

According to the gazette notice, the Judicial Service Commission was satisfied that a ground for removal of Judge Gitumbi had been disclosed, citing her inability to perform the functions of the office arising from mental incapacity under Article 168 (1)(a) of the Constitution.

President Kenyatta stated, "I note that the Judicial Service Commission having considered various medical reports was satisfied that a ground for removal of the Hon. Lady Justice Mary Gitumbi, on the reason of her inability to perform the functions of the office arising from mental incapacity under Article 168 (1)(a) of the Constitution had been disclosed."

A tribunal chaired by Justice Hellen Omondi Omollo will investigate the matter and submit its report to the President.
