DPP Clarifies Arrest of Two Judges

On July 22, 2021, law enforcement officers arrested and searched the chambers of Justices Juma Said Chitembwe and Aggrey Muchelule. The arrest was reportedly in connection to an ongoing investigation into a scandal at the Judiciary.

Contrary to reports by the Law Society of Kenya, the DPP's office has stated that it is not aware of the circumstances leading to the arrest or questioning of the two judges. The office has also not received any investigation files concerning them.

According to the DPP, in the event that the files are presented to the office for advice, the DPP will direct as appropriate.

The Law Society of Kenya has condemned the arrest and accused the Executive of intimidation tactics. In a statement, the LSK described the arrest as an 'ugly manifestation' of the Executive's assault on the independence of the Judiciary.
