Kenyan Whipped by Chinese Boss Awarded Sh3.07 Million

On July 11, 2021, the Employment and Labour Relations Court awarded a Kenyan man Sh3.07 million for the brutal treatment he suffered at the hands of his Chinese boss.

The man, who worked as a waiter at a Chinese restaurant in Kileleshwa, was subjected to physical and sexual abuse by his boss, including being whipped and forced to engage in sexual activities.

According to the court ruling, the victim suffered extreme cruelty, humiliation, psychological trauma, pain, and suffering as a result of the continuous sexual harassment, corporal punishment, and verbal abuse he endured.

The court also found that the victim's dismissal was a violation of his rights and against the Employment Act, and therefore entitled him to compensation.

Justice Mathews Nderi directed the management of the Chinese restaurant to pay the man Sh3 million for general damages and Sh72,000 for illegal dismissal.

The Chinese cook who perpetrated the abuse was deported before facing the law, sparking outrage and accusations that the government was condoning injustices and denying the victim his rights.
