Waiter Awarded Sh3 Million for Inhumane Treatment and Sexual Molestation

On February 2, 2020, a waiter at Chez Wou Restaurant in Kileleshwa was recorded being caned by his supervisor, a Chinese national, in a video that went viral on social media.

The High Court has since awarded Sh3.072 million to the waiter, identified as SOS, for the inhumane treatment he suffered at the hands of his supervisor, D.H.

According to the court ruling, SOS was subjected to physical assault, sexual molestation, and verbal abuse by D.H throughout his employment at the restaurant between October 2019 and February 2020.

Justice Nduma Nderi ruled that SOS had been subjected to inhumane treatment, including being threatened with dire consequences for refusing D.H's sexual advances.

The court further found that SOS was unfairly terminated from his employment contract and awarded him Sh72,000 in compensation.

Chez Wou Restaurant was found vicariously liable for the treatment meted out to SOS by D.H and was ordered to pay the damages.

On July 8, 2021, Justice Nduma Nderi ruled that SOS had been subjected to inhumane treatment and awarded him Sh3.072 million.
