On February 2020, a video of a Chinese restaurant employee whipping a Kenyan youth went viral, sparking widespread condemnation and outrage across the country.
The Employment and Labour Relations Court later ruled that the Chinese restaurant in Kileleshwa, Nairobi, had illegally dismissed the Kenyan youth, identified as SOS, whose rights were violated.
The court also found that SOS was sexually harassed by the Chinese employee, who had allegedly assaulted him for declining to give in to the boss's sexual advances.
According to the court ruling, SOS worked at the restaurant for three months before he was allegedly fired without compensation.
Interior CS Fred Matiang'i later deported the three Chinese nationals accused of infringing the rights of the Kenyan youth.
Speaking to Kenyans.co.ke, SOS urged all employees, local and foreigners, to respect their staff and the rule of law.
He also expressed gratitude to his lawyer for reviving the case and securing the compensation, but urged CS Matiang'i to ensure the foreigners return to Kenya to account for their mistake.
The victim stated that receiving the money would be a tall order and that his lawyers would take a certain percentage of the money as attorney fees.
On July 10, 2021, the court ordered the Chinese restaurant to pay the Kenyan youth Ksh3.07 million.
