On July 9, 2021, a 71-year-old man was sentenced to life in prison for defiling and impregnating his 15-year-old daughter in Kisumu County.
The man, who had separated from his wife and remarried, was found guilty of committing the act between June and September 2020.
According to the court, the victim had visited her father to pick foodstuff after he separated from her mother but the man turned on her, threatening her with a knife before defiling her.
The girl became pregnant as a result of the incident and later informed her stepmother about the incident, but she was turned away.
She opted to report the matter to a village elder who referred her to the police. Police arrested the suspect when the girl was confirmed to be pregnant.
However, the baby died at birth, and samples taken from the body for a paternity test revealed that the accused was the father.
During the trial, the suspect denied the accusations, claiming he overheard a doctor who attended to his daughter plotting to frame him.
However, the prosecution proved beyond reasonable doubt that he committed the act, and the medical examination report positively confirmed that he had been involved.
Principal Magistrate Everlene Enzere said that the offense committed by the old man deserved the strongest condemnation possible and sentenced him to life in prison.
