On June 30, 2021, the Building Bridges Initiative appeal case continued at the High Court, with lawyer Otiende Amollo challenging the judgement that declared the process illegal and null.
According to Otiende, the promoters of the BBI were Dennis Waweru and Junet Mohammed, not President Uhuru Kenyatta as cited in the judgement.
He argued that the presidential role was ceremonial and had no involvement in the constitutional process of coming up with the BBI bill.
“The judges ignored all evidence that promoters were Dennis Waweru and Junet Mohammed. How do you ignore such?’’ Otiende posed to the seven-judge bench.
He further stated that a popular initiative starts with an idea being muted and then converted into a bill, and that Dennis and Junet wrote to the IEBC asking for guidance in an affidavit and as promoters, which led IEBC to give them the go-ahead to collect signatures.
IEBC lawyers, led by former Attorney General Githu Muigai, were also set to issue their submission on the same day.
The seven-judge bench was guided by Court of Appeal President Daniel Musinga.
