South Sudan Firm Challenges Termination of Operations at Mombasa Port

Published on June 29, 2021, a South Sudanese clearing company, AA Global Logistics Ltd, is challenging the termination of its operations at the Port of Mombasa by two South Sudan government agencies.

The company, which has also named Kenya Ports Authority as an interested party, claims that the decision by the respondents to terminate its operations is high-handed and capricious.

According to the company's application seeking leave to institute judicial review proceedings, the termination of its operations is flawed in law for lack of any legal basis to warrant the termination.

AA Global Logistics Ltd also seeks an order stopping the Director General South Sudan Customs Service and South Sudan Embassy in Kenya from implementing their decision as contained in the letters dated April 29 and May 7.

The company's director, Mr. Zabadayo Kuol, states that the firm was appointed by the respondents as a clearing company and entered into an agreement with two companies to execute its mandate.

Mr. Kuol further states that there has been no complaint against the firm since it began its operations in 2019 and that the respondents' actions are an abuse of power and executed without any lawful cause.
