Eldoret Express Wins 13-Year Court Battle to Evict Squatters

On June 28, 2021, Justice Samuel Kibunja of the Environment and Land Court at Eldoret ruled in favor of Eldoret Express Company, allowing the company to evict over 1,000 squatters from Tawai farm in Trans Nzoia County.

The court determined that the squatters, who are members of Tawai Limited, had no legal grounds to claim the land, as they had defaulted on a loan used to acquire the land and the local bank had sold it to Kaitet Tea Estates, which later sold it to Eldoret Express.

Justice Kibunja also awarded police protection to Eldoret Express to effectively carry out the eviction order, stating that it would be desirable to have law enforcement agencies involved in the eviction exercise to maintain law and order.

The judgement has ended a 13-year protracted court battle over the Tawai farm, with Eldoret Express alleging that the squatters invaded the land during the 2007 General elections.
