On June 24, 2021, Court of Appeal President Daniel Musinga named the seven judges who would hear the appeal contesting the annulment of the Building Bridges Initiative constitution amendment bill.
The hearing was scheduled to commence on June 29, 2021. However, the court had made arrangements to minimize the risk of the spread of coronavirus, with the Judiciary pitching a tent outside the court premises where the case would be heard.
Justice Musinga ruled that the mode of hearing the case would be hybrid, allowing parties to choose between appearing in person or virtually.
He also gave all parties appealing the BBI invalidation by the High Court seven days to file written submissions, with the respondents allowed to file counterarguments through written submissions within 14 days of the appellants' filing.
The court set a limit of 40 pages for submissions and decided that the consolidated appeals would be heard through written submissions, with oral highlights limited to two hours for each respondent and appellant.
Justice Musinga appealed to all parties to handle the appeal with dignity and uphold utmost respect for each other.
The seven judges named to hear the appeal include Lady Justices Roseline Nambuye, Hannah Okwengu, Fatuma Sichale, and Justices Patrick Kiage, Steven Gatembu, and Francis Tuiyott.
