Published on June 22, 2021, Professor Tom Ojienda has written to CAS Hussein Dado demanding Sh2.6 million in legal fees.
The demand stems from a 2017 election petition loss by Dado, who was seeking re-election as Tana River County governor.
Ojienda's law firm, Tom Ojienda and Company Advocates, was awarded Sh2 million in costs, which was capped by the court.
A certificate of costs was issued on October 11, 2018, and Ojienda's firm has since engaged Dado multiple times to settle the debt, but to no avail.
Instead, Dado chose to engage in litigation, which has now reached a dead end, incurring further costs.
Ojienda is now demanding the principal amount of Sh2 million and interest of Sh640,000, totaling Sh2.6 million.
He is pleading with Dado to pay the full amount to prevent further proceedings, which could include bankruptcy proceedings.
“Please take notice that if we do not receive this money or a proposal on the same within 21 days from the date of receipt of this demand, we will institute bankruptcy proceedings against you and your estate. We do not need to belabor reminding you of the legal consequences of being adjudged bankrupt”, Ojienda says in the letter.
