Raila Calls for Transparency in Judiciary Stand-Off

On June 12, 2021, opposition leader Raila Odinga called for transparency in the judiciary stand-off, urging the executive to share evidence against six rejected judges.

Speaking on Saturday, Odinga emphasized the importance of Kenyan citizens understanding the reasons behind the government's actions on the matter.

He appealed to all leaders of the three branches of government to seek common ground in their respective powers, saying that no one branch can help Kenyans solve their problems without the help of the other.

According to Odinga, the country has swung from one absurd state of affairs to another due to a competitive relationship between the branches of government, rather than a complementary one.

He recalled that before the 2010 constitution, the country had seen an era where the separation of powers was abused, and the executive interfered with the functions of the other branches, making democratic governance impossible.

However, Odinga noted that the 2010 Constitution re-calibrated the constitutional order and pulled the country back to democratic ideals.

Unfortunately, it now appears that in doing so, we have ended up with a catastrophic and extreme swing of the pendulum as our three branches of government try to find their respective positions in the constitutional order.

President Uhuru Kenyatta has faced condemnation from a section of Kenyans after he failed to swear in six of the 41 judges that had been recommended to him by the Judicial Service Commission (JSC).
