On May 7, 2021, a significant development shook the Kenyan Senate as Speaker Ken Lusaka officially declared the seat of Nominated Senator Isaac Mwaura vacant.

The gazette notice, which served as the formal declaration, read:

"It is notified for the information of the general public that pursuant to Article 103 (1) (e) (i) of the constitution and section 37 of the Elections Act, the seat of the Member of the Senate elected under Article 98 (I) (d) of the constitution and held by Hon. Isaac Mwaura Maigua became vacant, with effect from the 7th May, 2021."

The decision to declare Mwaura's seat vacant stemmed from his alleged disloyalty to the Jubilee Party, which had previously expelled him for campaigning for an opposing candidate. Mwaura's defense that he was not furnished with sufficient details of the charges against him was dismissed by the party's tribunal.

As a result of the expulsion, Mwaura was joined by five other senators, including Millicent Omanga, Christine Zawadi, Mary Yiane, Prengei Victor, and Naomi Jilo, in losing their seats.
