On May 6, 2021, a ruling by Justice Hillary Chemitei of the Nakuru High Court sent shockwaves through Nyandarua County Assembly, reaffirming the reinstatement of Speaker Wahome Ndegwa.
The court issued a temporary injunction and stay of the assembly's decision to impeach the speaker, pending a hearing and determination of the suit.
According to the ruling, the assembly failed to meet the 75% threshold required for impeachment, with only 26 members voting in favor of the motion, representing less than 70% of the total votes.
Eleven members of the county assembly (MCAs) voted against the impeachment motion, accounting for nearly 30% of the total votes cast.
The assembly's decision to impeach Speaker Ndegwa was deemed invalid, and the status quo has been maintained until the matter is resolved.
