On May 3, 2021, lawyers representing activist Memba Ocharo announced that the case challenging the Chief Justice selection process was effectively over.
Shadrack Juma, Ocharo's lawyer, stated that the Court of Appeal's decision to allow the process to continue had rendered the case moot.
‘‘Ocharo was in court, but the Court of Appeal ruled that the process should continue, making the case now only useful for academic purposes,’’ Juma said.
He expressed disappointment with the decision, claiming that the court had ignored Chapter Six of the Constitution and infringed on the High Court's powers.
Martha Koome, the CJ nominee, defended the selection process, saying she was equal to the task.
‘‘I appreciate this was after a thorough, rigorous, and competitive process that saw some of the best legal minds come forward as capable candidates demonstrating their willingness to serve Kenyans,’’ Koome stated in her acceptance statement.
