Weston Hotel's management is embroiled in a land ownership dispute with the Kenya Civil Aviation Authority (KCAA). Priority Ltd, a company at the centre of the ownership row, has filed an application in support of the hotel's bid to dismiss KCAA's petition.
According to the application, Priority Ltd claims that the Environment and Land court lacks jurisdiction to entertain and determine the petition filed by KCAA. The company argues that KCAA's claim is res-judicata, meaning it has already been decided by the National Land Commission (NLC).
Priority Ltd further claims that the title to the land was acquired legally and in good faith, and that KCAA has no evidence to the contrary. The company maintains that the suit by KCAA should be summarily dismissed.
Weston Hotel's management has also maintained that it was an innocent purchaser of the land and that it paid money to acquire the plot. The hotel claims that the case by KCAA has been filed with ulterior motives, especially after NLC made a finding that the title was acquired legally.
Through its lawyer, Ahmednassir Abdullahi, Weston Hotel wants the case dismissed, arguing that KCAA has not made out a case deserving of any of the prayers sought. The hotel also wants the court to uphold the sanctity of the title and dismiss KCAA's petition.
