Kenya's High Court Orders Kenha to Pay Ahmednassir Sh750,000 for Damaged Bentley

On August 25, 2018, Ahmednassir set out on a road trip with his two daughters to Tanzania from Nairobi, but the journey was cut short when his Bentley Bentayga windscreen was damaged by stones and shrapnel emanating from a Kenha road repair project.

Five days later, on August 30, 2018, while returning from the trip, the windscreen of Ahmednassir's Bentley was damaged further by Kenha employees who were repairing the road.

Magistrate Edwin Mulochi, who presided over the case, ruled that Kenha was liable for the damage caused to Ahmednassir's car and ordered the organization to pay Sh750,000 in compensation.

According to Mulochi, the award of Sh750,000 was to restore Ahmednassir to the position he was in before his car's windscreen was damaged.

However, Mulochi declined to award general damages, stating that doing so would amount to unjust enrichment.

Reacting to the court's decision, Ahmednassir expressed his gratitude, saying that he now believes that justice still exists in Kenya's judicial system.

‘I have now accepted that there is hope from Kenya judicial system. Now a path has been made to be followed,’ Ahmednassir tweeted.
