On July 30, 2020, the High Court made a significant ruling in favor of Kandara Member of Parliament Alice Wahome, ordering the Inspector General of Police Hillary Mutyambai to restore her security detail.
Justice James Makau ruled that the withdrawal of Wahome's security officers was illegal and without evidence of any crime committed by the MP.
The court found that the mere allegation of an electoral offence by the MP was not sufficient to warrant the withdrawal of her security.
Wahome had argued that the move was meant to intimidate her to change her stand on bad governance and her political beliefs and affiliation.
Through her lawyer, Stephen Gitonga, Wahome stated that the decision was discriminatory in nature, as all other MPs continued to enjoy security provided by the National Police Service.
Wahome had been unable to discharge her functions effectively due to the withdrawal of her security, the court heard.
However, the Inspector General of Police, through Director of Operations Henry Borma, had argued that the decision was made following reports implicating some VIPs in crime incidences and unlawful conduct.
Justice Makau ruled that there was no evidence to support the allegations against Wahome, and therefore, the withdrawal of her security was illegal.
