On July 28, 2020, Jennifer Mukonyo Mbogo and Nathan Loyd Ndung'u, the sister and husband of politician Steve Mbogo, wrote to the Director of Public Prosecution (DPP) Noordin Haji seeking a review of the criminal file against them.
The couple is facing Sh 18.5 million fraud charges, which they claim is a civil matter. They entered into an agreement with Ezetel Limited, a company they are alleged to have defrauded, for the purpose of business.
According to their lawyer, Cliff Ombetta, the agreement was entirely commercial in nature with clear bonafide intentions. The couple claims they have been in the avocado export business for a long time, and the issue of 'false pretenses' does not arise.
The couple also accuses DCI officers of harassing them and maliciously incarcerating them. They claim the officers demanded title deeds of their business premises in Embakasi and motor vehicles as security for the 'loan', which was clearly in bad faith.
They intend to sue officers Nderitu and Njue in their personal capacities for acting outside the limits of the law. They also plan to sue for defamation, mental torture and anguish, malicious incarceration, and damages in terms of business lost.
