Kenya Alliance Insurance Company Ordered to Settle Claim Within 30 Days

Published on July 27, 2020, the Insurance appeals tribunal has ordered the Kenya Alliance Insurance Company to settle an insurance claim within 30 days.

The tribunal, led by chairman Wambua Kilonzo, upheld a decision by the Insurance Regulatory Authority (IRA) dated December 20, 2019, which found the Kenya Alliance Insurance company liable to honor the insurance policy of John Mukuruma Wainaina.

Wainaina's vehicle, a Probox with registration number KCN 896E, was stolen in 2018.

According to the tribunal, the insurance company had declined the claim in a letter dated May 17, 2017, citing that the whole premium for the policy was outstanding at the time of the theft.

However, the tribunal ruled that the insurance company was liable to pay the claim and ordered them to settle it within 30 days.

Should the insurance company fail to adhere to the order, the IRA is at liberty to take action as may be appropriate under the Insurance Act.

The ruling was made by the tribunal, which included chairman Wambua Kilonzo, Martin Mithega, Thomas Koyier, Monica Micheke, and Charles Kipkulei.
