Foreign Envoys Urge Cooperation Between Kenya's Executive and Judiciary

On July 17, 2020, foreign envoys in Kenya, including US Ambassador Kyle McCarter, British High Commissioner Jane Marriott, and European Union Ambassador Simon Mordue, jointly called for cooperation between the Executive and Judiciary in a statement commemorating International Justice Day.

The envoys emphasized the need for dialogue and cooperation between the two institutions, which work independently but cooperatively. They urged the resolution of the ongoing stand-off between President Uhuru Kenyatta and Chief Justice David Maraga, which has been centered around issues such as the appointment of judges.

“Resolve the delay in the appointment of judges to vacant positions. Where there are substantial allegations of corruption, these should be swiftly and transparently addressed, while not delaying the appointment of other judges,” the envoys stated.

The envoys also advocated for the strengthening of collaboration among all agencies that work across criminal justice, to ensure that cases flow efficiently. They commended the ongoing reforms within the National Police Service and urged for them to be scaled up.

Additionally, the envoys advised for the fully funding of the National Legal Aid Service to provide legal representation for poor accused persons. They emphasized the need for adequate resources and oversight mechanisms to ensure accountability in Kenya's Judicial System.
