On July 16, 2020, the High Court delivered a landmark judgment in the case of Eng. Geoffrey Sang, the embattled Acting Chief Executive Officer of the National Water Harvesting and Storage Authority.
The court, presided over by Justice George Odunga, ruled that the DCI had no powers to institute any criminal charges against Eng. Sang unless authorized by the Office of the Director of Public Prosecutions (DPP).
Eng. Sang had challenged the DCI's decision to arrest and charge him with abuse of office, alleging that the move was maliciously instigated by individuals at the water harvesting authority and officials at the DCI.
According to the court's ruling, the DCI's action was illegal, and the DPP and DCI have been barred from instituting criminal proceedings against Eng. Sang.
The court's decision effectively nullifies the DCI's charges against Eng. Sang, who was arrested over a suspected dam construction scandal.
