Nairobi County Loses Control of 400 Parking Bays at Telposta Towers

On July 12, 2020, a court ruling shook the Nairobi County government, stripping it of control over 400 parking bays at Telposta Towers.

The Environment and Lands Court, presided over by Justice Samson Okong'o, found that the property belonged to Teleposta Pension Scheme Trustees, a private entity.

The court's decision was based on a 2005 agreement between the defunct City County Council and the pension scheme, in which the council surrendered the property in exchange for Sh15 million.

With the payment received, the City government relinquished its interest in the disputed property, allowing the pension scheme to develop it and create 408 parking bays at the basement, as well as a recreational area.

However, the County government attempted to evict the security personnel manning the parking bays in 2010, sparking a court case that ultimately led to the ruling in favor of the pension scheme.

The County government had denied selling the property to the scheme, claiming that the title issued after the plot was amalgamated with another was illegal, null, and void.

Justice Okong'o, however, ruled that the County's actions amounted to trespassing, as they sought to levy parking fees on the scheme's customers and tenants.
