Published on July 9, 2020, Grace Wakhungu, a 79-year-old convict in the Sh 297 million maize scandal, has filed an application at the high court seeking bail pending the hearing and determination of her appeal.
Through her lawyer, Paul Muite, Wakhungu is also seeking an order directing the officer-in-charge of Langata Women's Prison to have a government geriatric and psychiatrist examine her and file a report on her physical and mental health.
According to Muite, Wakhungu's condition requires professional assessment to prevent permanent deterioration of her physical and mental health.
Wakhungu's appeal has 'overwhelming chances of success' due to the trial court's conviction in the absence of mens rea imputable to her, Muite argued.
He further submitted that Wakhungu's medical conditions may have rendered her unable to stand trial and understand the nature and consequences of the proceedings.
Wakhungu's lawyer also claimed that the trial court imposed an unlawful or harsh sentence, guided by extraneous considerations.
Wakhungu and her co-accused, Sirisia MP John Walukhe, face over 60 years in prison if they do not pay a Sh 700 million fine.
