Published on July 9, 2020, a High Court judge dealt a significant blow to Kitui Governor Charity Ngilu's efforts to prevent her impeachment by the county's MCAs.
Justice Weldon Korir ruled that Ngilu's application did not meet the necessary threshold to be granted conservatory orders, effectively allowing the impeachment proceedings to continue.
The judge also faulted Ngilu for filing the case in Nairobi County instead of Kitui, where the impeachment is taking place.
According to the court, impeachment proceedings are akin to election petitions, and it would be advisable for any person seeking to file a court case to approach a High Court within the county where the impeachment is occurring.
Justice Korir emphasized the importance of local residents having access to the court where the proceedings are taking place.
