On July 8, 2020, a petition was filed against Gatundu South MP Moses Kuria at the Milimani Law Courts in Nairobi, seeking to declare him unfit to hold public office.
The petitioner, Elijah Gicharu Kimani, claims that after conducting a self-driven audit of the Gatundu South Constituency Development Fund, he discovered cases of nepotism, abuse of office, and conflict of interest in the award of tenders worth Sh170 million.
According to the petition, MP Kuria awarded contracts amounting to Sh32,531,540 in six learning institutions to Finishline Construction Ltd, a company owned by his brother Aloise Kinyanjui Kuria.
Another brother, Charles Regeru Nguru, who is the director of Mwaura Timber Yard Ltd, was awarded tenders worth Sh15,761,445 in three schools, while John Nome Kuria and James Koigi Kuria, who are also MP Kuria’s brothers, were awarded contracts amounting to Sh5,808,468 in Mutungu Secondary School.
The petitioner also alleges that Lujatech Enterprises Ltd, a company whose directors are Charles Regeru Nguru (brother), Jane Muthoni Regeru (sister-in-law), Lucy Wambui Regeru (niece), and Teresia Mwihaki Regeru (niece), won a tender worth Sh10,267,955 in two schools.
Furthermore, the petitioner claims that John Ngige Kuria (brother) was awarded a tender worth Sh31,525,120 in two schools through his company Numerical Strength Ltd, while Jane Wambui Kuria (sister) received contracts amounting to Sh9,814,240 in two schools through her company Kiki Holdings Ltd.
“…we discovered and strongly believe that the respondent directly influenced the awarding of the contracts to companies owned by his relatives,” Gicharu states in the petition.
