On July 8, 2020, a Nairobi court issued a directive to the office of the Director of Public Prosecutions (DPP), the Directorate of Criminal Investigations (DCI), and the media to refrain from commenting on the merits of the Babu Owino and DJ Evolve case.
The court, presided over by Milimani Senior Principal Magistrate Bernard Ochoi, also directed that the matter be mentioned on August 11, 2020, to confirm whether the victim, Felix Orinda, alias DJ Evolve, has recorded a statement.
Babu Owino, through his lawyer Cliff Ombeta, raised an objection, accusing the DPP of overstepping his mandate by allegedly inciting Embakasi East constituents to recall him as their MP.
According to Ombeta, the actions of the DPP are 'affecting the emotions of the accused person,' and he urged the State prosecutor to 'stick to his line.'
The controversy surrounding Babu Owino began after an interview with DJ Evolve aired by NTV, in which the victim stated that since undergoing surgery following the shooting incident, he has been left struggling to talk and unable to do anything for himself.
The MP's lawyers later served the media house with a demand letter, terming the story as 'scandalous and libelous' and aimed at pitting him against the public.
Babu Owino is alleged to have shot and wounded DJ Evolve at Kilimani's B-Club in January 2020.
